By using the Platform, you represent and warrant that:

• You are legally capable of entering into a binding agreement;

2. Description of Services

The Platform allows users to:

• Discover nearby yard sales;
• Post and manage yard sale listings;
• Upload sale descriptions, dates, images, and locations;
• Create custom routes to visit sales;
• Rate and review yard sales;
• Comment on listings; and
• Interact with other users.

We do not own, operate, inspect, endorse, or guarantee any yard sale, seller, item, or transaction listed on the Platform.

3. User Accounts

You agree to:

• Maintain the confidentiality of your login credentials;
• Be responsible for all activity under your account; and
• Notify us immediately of unauthorized account use.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

Users may submit content including listings, photos, reviews, comments, ratings, route information, and other materials (“User Content”).

By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, modify, distribute, and promote such content in connection with operating and marketing the Platform.

You represent and warrant that:

• You own or have permission to post the content;
• The content does not violate any law or third-party rights; and
• The content is not false, misleading, defamatory, obscene, or harmful.

5. Prohibited Conduct

You agree not to:

• Post fraudulent or misleading yard sale listings;
• Harass, threaten, or abuse other users;
• Upload viruses or malicious code;
• Attempt unauthorized access to the Platform;
• Use automated bots or scraping tools;
• Post illegal, stolen, counterfeit, or prohibited items;
• Impersonate another person or business; or
• Use the Platform for unlawful purposes.

We reserve the right to remove content or suspend accounts at our sole discretion.

6. Listings and Transactions

The Platform acts solely as a venue for users to share information about yard sales.

We are not responsible for:

• The accuracy of listings;
• Product quality or safety;
• Seller conduct;
• Pricing disputes;
• Transactions between users; or
• Injuries or damages occurring at any sale location.

Users participate in sales and transactions at their own risk.

7. Ratings and Reviews

Users may leave ratings and reviews regarding yard sales.

Reviews must:

• Be truthful and based on actual experiences;
• Avoid offensive or discriminatory language; and
• Not contain spam, threats, or false statements.

We may remove reviews that violate these Terms.

8. Location Services

Certain features may require access to your device’s location.

By enabling location services, you consent to our collection and use of geographic data to:

• Display nearby yard sales;
• Generate routes; and
• Improve user experience.

You may disable location access through your device settings, though some features may become unavailable.

9. Intellectual Property

All Platform content excluding User Content—including logos, branding, software, design, text, graphics, and functionality—is owned by or licensed to the Company and protected by intellectual property laws.

You may not reproduce, distribute, or exploit any Platform content without prior written permission.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy. Please review it carefully.

11. Third-Party Services

The Platform may integrate with third-party services including maps, payment processors, analytics providers, and advertising partners.

We are not responsible for third-party services, content, or policies. Your use of third-party services may be subject to separate terms and conditions.

12. Disclaimer of Warranties

The Platform is provided “as is” and “as available.”

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy or reliability of content.

We do not guarantee uninterrupted or error-free service.

13. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

Our total liability for any claim shall not exceed the amount paid by you to us, if any, during the preceding twelve (12) months.

You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, employees, and agents from any claims, damages, liabilities, losses, and expenses arising from:

• Your use of the Platform;
• Your User Content;
• Your violation of these Terms; or

You may stop using the Platform at any time.
